Official Rules: GMAC 2023 Prospective Student Survey ASR Random Draw Promotion – PRC

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. ENTRY INTO THE PROMOTION CONSTITUTES ACCEPTANCE OF THESE OFFICIAL RULES. VOID OUTSIDE OF THE PEOPLE’S REPUBLIC OF CHINA (“PRC”) AND WHERE PROHIBITED OR RESTRICTED BY LAW. FOR PURPOSES OF THESE OFFICIAL RULES, PRC SHALL EXCLUDE HONG KONG SPECIAL ADMINISTRATIVE REGION, MACAU SPECIAL ADMINISTRATIVE REGION AND TAIWAN. THESE RULES APPLY ONLY FOR THE ADDITIONAL SCORE REPORT (“ASR”) PROMOTION, THOUGH ENTRANTS FROM THE PRC INITIALLY HAVE THE OPPORTUNITY TO CHOOSE FROM WHICH PROMOTION TO ENTER.

Binding Agreement: These Official Rules (“Rules”) will provide you with the information you need to successfully enter the GMAC Prospective Student Survey ASR Random Draw Promotion – PRC ("Promotion"). These Rules form a binding contract between the Graduate Management Admission Council. ("GMAC" or “Sponsor”) and you, as an entrant into the Promotion. By entering the Promotion or otherwise participating in the activities on the Promotion website, you agree to be bound by these Rules. If you breach a provision of these Rules, you will forfeit your entry into the Promotion. All decisions of GMAC on all matters pertaining to the Promotion are final and binding. No queries, challenges or appeals may be made or entertained regarding GMAC's decision on the same. If you have questions, please contact GMAC at gmac-research@gmac.com.

Eligibility: To be eligible to enter this Promotion, you must: (i) submit an entry as described below under “How to Enter”; (ii) be a legal resident of PRC at the time of entry; (iii) be at least 18 years old at the time of entry; (iv) be a holder of a valid PRC Identity Card at the time of entry; (v) have a valid email address and Internet access prior to the start of the Term (as defined in the Promotion Term section below); and (vi) be a prospective graduate management education student. Current employees, directors, and officers of GMAC, their affiliates, agents, independent contractors and their immediate families and people living in their households are not eligible to enter the Promotion. THIS PROMOTION IS VOID OUTSIDE OF THE PRC AND WHERE PROHIBITED OR RESTRICTED BY LAW. This Promotion is subject to all applicable laws and regulations, including applicable economic sanctions and other international trade regulations.

Promotion Sponsor: Graduate Management Admission Council, P.O. Box 2969, Reston, VA 20195, USA, is the sponsor of the Promotion.

Promotion Term: The Promotion begins at 12:01 AM EST on the first day of each month (“Term Start Date”) and ends at 11:59 PM EST on the last day of the applicable month (“Term End Date”) Each month will be considered its own "Term”. Ten (10) winners will be determined for each Term laid out in the corresponding chart below. Sponsor’s computer, or that of its designee, will serve as the official time keeper for the Promotion. Entries received before or after the specified Term will be rejected automatically.

How To Enter: NO PURCHASE IS NECESSARY TO ENTER TO WIN. During the Term, you must submit your entry as follows:

  1. Choose to participate in this Promotion for the Additional Score Reports random drawing;
  2. Complete the GMAC Prospective Students Survey (“Survey”).
  3. Provide your name and email address so that GMAC may contact you regarding the Promotion. Providing this information constitutes affirmative consent to the Official Rules.

LIMIT: Entry to this Promotion is limited to one entry per person. All entries discovered to have been submitted by the same individual using multiple accounts will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for: (i) lost, late, incomplete, invalid, illegible, or misdirected entries, which will be disqualified; (ii) failed, partial or garbled computer transmissions; (iii) technical failures of any kind, including, but not limited to, electronic malfunctioning of any network, hardware or software; or (iv) any error, technical or otherwise. Sponsor reserves the right, in its sole discretion, to disqualify any entry not in compliance with these Rules. 

The email address you provide will be our primary means of communication with you. Once you submit your entry, no further changes can be made to the entry even if there is time remaining in the Term.

In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the selected entry.

Electronic Communications: By participating in the Promotion and submitting your Promotion entry, you agree to communicate for the purpose of this Promotion with the Sponsor electronically. By agreeing to do business electronically, you: (i) agree that your act of clicking your consent to these Rules is a binding form of your electronic signature, which you agree binds you to these Rules and our use of your personal information for this Promotion, (ii) represent that you have Internet access and a valid email address enabling your access to www.mba.com and to receive communications and documents electronically, (iii) represent and warrant that you have clearly read, understood and consented to these Rules, and (iv) represent that you have a printer or other device to print or otherwise save communications and documents including, without limitation, these Rules and that you have, in fact, printed or otherwise saved a copy of these Rules for your records. The consent is effective unless and until you withdraw it or unless otherwise provided by applicable laws and regulations. You may withdraw your consent to electronic communication and delivery of documents, update your contact information, or request a free paper copy of these Rules at any time by contacting us as set forth in these Rules. We will send you a confirmation notice once we have processed your change request.

Winner Selection:  On or about the first Monday after the Term from among all eligible entries, the Sponsor will randomly select ten (10) potential winners from among all eligible entries received.

Winner Notification: Prize drawings will be conducted at Sponsor’s office. Potential winners will be notified by Sponsor via email on or about the day after they have been selected by the Sponsor as a potential winner. Each potential winner will have (5) five business days from the date of the notification to claim his or her prize. Winners will be required to present the following items to collect the prize (i) the prize notification email sent by GMAC; and (ii) their PRC Identity Card. Winners are not permitted to authorize representatives to collect any prizes on their behalf.  The following may (at GMAC’s sole and absolute discretion) result in the disqualification of the potential winner and the selection of an alternate winner from all remaining eligible entries: (a) failure to present the relevant prize notification email sent by GMAC and a valid PRC Identity Card of the winner when collecting of the prize; (b) where the particulars of the PRC Identity Card presented by a winner does not correspond with the details submitted in the winner’s entry for this Promotion; (c) the return of any notification email as undeliverable, (d) the inability of GMAC to contact a potential winner within five (5) business days; or (e) the failure of the potential winner to respond. GMAC and its parent company, affiliates, subsidiaries, employees, agents, officers and directors, advertising and promotion agencies, and their respective officers, directors, employees and their respective agents will not be liable for any unsuccessful efforts to notify a potential winner under such circumstances.

Prizes: For each Term, Ten (10) potential winners (PRC only) will each receive:

  • One (1) Additional Score Report for the GMAT exam (Approximate Retail Value (ARV) USD $35.00/RMB ¥240.41 (as may be adjusted from time to time based on local currency as of the Term Start Date);
  • The total ARV of all prizes potentially awarded is $350.00 USD/RMB ¥2404.08 (as may be adjusted from time to time based on local currency as of the Term Start Date).

The actual value of prizes may vary and Sponsor will not award or compensate for the difference (if any) between approximate and actual value of the prizes in any way. The odds of winning depend on the number of entries received and each entry has an equal chance of winning. Actual prizes may differ from promotional images and/or descriptions, and any promotional images and/or descriptions are provided for reference only. The winner is responsible for any and all federal, state/provincial/territorial, and local taxes, fees and surcharges and taxes (whether foreign or domestic, and including income, sales, and import taxes) on prizes. GMAC reserves the right to substitute the prize with a different prize of equal or greater value without prior notice at its sole and absolute discretion. No prize transfer, replacement, exchange, return, assignment or substitution by a winner is permitted, and the prize is not transferable or exchangeable for cash or other items. If a potential winner declines the prize, fails to claim the prize, is unavailable to receive the prize, fails to abide by the Rules, or is ineligible in any other manner (including being deemed ineligible by GMAC), GMAC may disqualify such potential winner and select an alternate winner from all remaining eligible entries. GMAC reserves the rights to deal with all unclaimed prizes in any manner it deems fit. The potential winner may be required to complete an affidavit of eligibility, a liability release and (where legal) a publicity release, which must be returned within the time period specified by GMAC in the notification. The winners agree to abide by the terms and conditions (if any) which are listed by the prize suppliers regarding the relevant prizes. GMAC and the prize suppliers will not be responsible for any consequences due to the redemption or use of the prizes to the maximum extent permitted by applicable laws and regulations.

Limitations on Liability:Except as otherwise prohibited by laws and regulations, entrants and winners, individually and on behalf of their relatives, heirs, assignees, executors, and administrators, agree that they shall enter the Promotion at their own risk and shall be responsible for all risks of participating in the Promotion, and hereby permanently, irrevocably and forever waive and release any and all rights, demands, losses, liabilities, claims and causes of action whatsoever which you may now or hereafter be entitled to assert against Sponsor, its affiliates, parent, and subsidiary companies, its employees, agents and officers, advertising, marketing and promotion agencies, as well as all others associated with the development and execution of the Promotion (collectively, the “Released Parties”), including, but not limited to, any death, injury, loss of enjoyment or other harm or loss of any nature whatsoever caused by, contributed to, or arising out of the Promotion and/or any prize awarded, any claim or demand for additional compensation or any other claim or demand related to the Promotion or what the Sponsor provides, and forever release and discharge the Released Parties from any and all liability with respect thereto. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Promotion submissions or entry forms; or alteration of entries or entry forms, or any registration or winner selection.

WITHOUT LIMITING THE FOREGOING, AND EXCEPT WHERE PROHIBITED BY LAW, EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE PRIZE, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, CORRESPONDING TO DESCRIPTION, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Conditions: Unless participants expressly opt out in accordance with the procedures and conditions as prescribed by GMAC, you expressly consent to the collection and use of your registration information for this Promotion and for other marketing purposes (including direct marketing), and the transfer of your personal information and your registration information to the United States, where Sponsor’s parent company and its data processors are located.

If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consented thereto. You agree to provide Sponsor with written evidence of such consent as soon as practicable and at your costs and expense upon receiving a request to provide such evidence from Sponsor. You further warrant that your actions do not violate your employer’s, company’s or principal’s policies and procedures, or any applicable laws in your jurisdiction(s).

Right to Disqualify, Modify, Cancel or Suspend: GMAC reserves the right, at its sole and absolute discretion, to disqualify any individual(s) who tampers with this Promotion, and/or to cancel, terminate, modify, or suspend the Promotion for any reason. GMAC reserves the right to disqualify any entry from this Promotion or any future promotion if, in its sole and absolute discretion, GMAC reasonably believes that any person has attempted to undermine the legitimate operation of GMAC or the Promotion website by cheating, deception, or other unfair practices, or has tampered with any of GMAC's websites, the submission process, violated these Rules, or acted in an unsportsmanlike or disruptive manner, or annoyed, abused, threatened, or harassed GMAC, its employees, its agents, its assigns or any other participant. GMAC also reserves all rights to claim against such participant(s) any damage or loss suffered by GMAC arising out of or in connection with any such actions.

Governing Law: The Promotion and the rights and obligations of all entrants and entries shall be governed by and construed in accordance with the laws of the People’s Republic of China. Should any provision of these Rules be held to be void, invalid, unenforceable, or illegal by a proper legal authority, the validity and enforceability of the other provisions shall not be affected.

Dispute Resolution: All disputes, claims or demands that relate to these Rules, including the formation, interpretation, breach or termination thereof, and whether the claims asserted are arbitrable, will first be brought to the attention of the other party and will be resolved individually, without resort to any form of class action. The receiving party shall have sixty (60) days from the date of such notice to remedy the described breach or violation and notify the complaining party in writing of the resolution. If the dispute, claim or demand is not resolved to the satisfaction of the complainant within 60 days, the complainant may request an informal resolution conference (mediation), which if agreed to by the other party will be scheduled to occur within twenty-one (21) days of the written response. Each party shall have the right to be represented at such a conference by counsel and will ensure that a decision-maker with full and complete authority to resolve the dispute attends the conference. Such conference will be in front of a third party mediator chosen by the parties. If the parties do not agree to a conference or are unable to resolve a dispute after such a conference, the parties agree that exclusive jurisdiction for any dispute, claim or demand related in any way to these Rules will be decided by binding arbitration. All disputes between the parties, of whatsoever kind or nature arising out of these Rules, shall be submitted to JAMS (www.jamsadr.com<http://www.jamsadr.com) for binding arbitration under the JAMS International Arbitration Rules & Procedures then in effect (the “Arbitration Rules”) before one arbitrator to be mutually agreed upon by both parties. If the parties fail to agree upon the arbitrator to be appointed, the arbitrator shall be appointed in accordance with the Arbitration Rules. The seat of the arbitration shall be Hong Kong. The language to be used in the arbitral proceedings will be English. Judgment upon the award rendered by the arbitrator may be entered by any court having jurisdiction thereof. The parties agree to share equally in the arbitration costs incurred.

Data Privacy: Your personal information will be used to fulfill the terms of this Promotion and may therefore be shared with any subcontractor, agent or partner that assists or is otherwise involved in the Promotion or website operation and as specified in GMAC's privacy statement available at http://www.mba.com/privacy, and may be used by GMAC for direct marketing purposes and to inform you of products, services and other marketing materials which GMAC considers to be of interest to you (if applicable). You may request access to, and/or correction of your personal information, and/or opt-out of any direct marketing provided by GMAC in accordance with the procedures and conditions as prescribed by GMAC. Miscellaneous:  Sponsor reserves the right to change these Rules or any the terms and conditions of this Promotion in its sole and absolute discretion at any time and without prior notice.

If there is any discrepancy between the Chinese (if any) and English version of these Rules or any terms and conditions of this Promotion, the English version shall apply and prevail.
