These Official Rules (“Rules”) will provide you with the information you need to successfully enter the Drawing. These Rules form a binding contract between the Graduate Management Admission Council® ("GMAC®") and you as an entrant into the Drawing. By entering you agree to be bound by these Rules. If you breach a provision of these Rules, you will forfeit your entry into the Drawing. If you have questions, please contact GMAC at email@example.com.
To be eligible to enter the Drawing, you must (i) have agreed to take the 2017 Corporate Recruiters Survey (“Survey”) and answer all the survey questions; and (ii) be above the age of majority in the jurisdiction in which you reside at the time of entry. Employees, officers, and directors of the Graduate Management Admission Council (GMAC), its agents or affiliates, advertising or promotional agencies, and their immediate families and those living in their households, are not eligible to participate in the Drawing. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. All federal, state, and local laws and regulations apply, including applicable economic sanctions and other international trade regulations.
The Survey begins at 12:01 a.m. Eastern Standard Time (EST) on February 8, 2017 and ends at 11:59 p.m. Daylight Savings Time (DST) on March 17, 2017 (“Term”).
Graduate Management Admission Council, P.O. Box 2969, Reston, VA 20195 USA, is the sponsor of the Drawing (“Sponsor” or “GMAC”).
HOW TO ENTER
NO PURCHASE IS NECESSARY TO ENTER OR WIN. During the Term, potential entrants will receive an email from Sponsor with a link to the Survey. To enter the Drawing, click on the link and complete the survey questions during the Term. You must complete the survey during the Term to be eligible to receive the prizes described below.
LIMIT: ONE (1) ENTRY PER PERSON. Subsequent entries will be disqualified. All entries become the property of Sponsor. They will not be returned or acknowledged. Sponsor is not responsible for lost, late, misdirected, mutilated, incomplete, or illegible entries, or for any computer-related, online, telephonic, or technical malfunctions that may occur. Entries are void if they are in whole or in part illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error, forged, mechanically reproduced, or obtained through fraud or theft.
In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address. A selected entrant may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the selected entry.
By submitting your Drawing entry, you agree to communicate electronically with Sponsor for the purpose of this Drawing. By agreeing to do business electronically, you represent that you have Internet access and a valid email address enabling your access to the survey and to receive communications and documents electronically. This consent is effective unless and until you withdraw it. You may withdraw your consent to electronic communication and delivery of documents, update your contact information, or request a free paper copy of these Rules at any time by contacting us as set forth in these Rules. We will send you a confirmation notice once we have processed your change request.
Fifty (50) Prize winners will be randomly selected to receive a gift card (e.g., Amazon, American Express, or similar) in the amount of US$100.00. Approximate Retail Value (“ARV”): US$100.00. Total ARV is US$5,000.00. Winner is responsible for any and all taxes. Odds of winning depend on the number of eligible entries received.
At the end of the Term, Sponsor will randomly select fifty (50) potential prize winners from all eligible entrants. All decisions on all matters pertaining to the Drawing are final. Winners are responsible for any and all taxes, delivery fees, and/or costs related to the processing, maintenance, set up or receipt of the prize by the winner. Sponsor reserves the right to substitute a prize of equal or greater value. Winners may be ineligible to receive a prize if prohibited by applicable economic sanctions or other international trade regulations.
Random selection of the potential winners will occur on or about March 22, 2017, from among all eligible entries received. Prize drawings will be conducted at Sponsor’s office in Reston, Virginia. The potential winners will be notified by email on or about March 23, 2017. Potential winners will have fourteen (14) days from notification to claim his or her prize. Sponsor and its affiliates, subsidiaries, employees, agents, officers and directors, advertising and drawing agencies, and their respective officers, directors, employees and their respective agents will not be liable for unsuccessful efforts to notify a winner. The prize will be delivered electronically, by email. No prize transfer, assignment or substitution by winner permitted. Sponsor may substitute the prize for one of equal or greater value. Winners may be required to complete a release and provide tax identification or other information prior to receiving their prize. If any potential winners declines the prize, fails to claim the prize by 5 p.m. EDT, March 30, 2017, is unavailable for prize fulfillment, fails to abide by the Official Rules, or is ineligible, Sponsor may select an alternate winner from all remaining eligible entries. If any prize or prize notification is returned as undeliverable, that prize is forfeited and Sponsor may select an alternate winner from all remaining eligible entries.
LIMITATION OF LIABILITY; CONDITIONS
- Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Drawing.
- By participating, entrants and winners release Sponsor, its affiliates, parent, and subsidiary companies, its employees, agents and officers, advertising and promotion agencies, as well as all others associated with the development and execution of this Drawing, from and against any and all liability with respect to or in any way arising from the Drawing and the awarding and use of the prizes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to Drawing entries or entry forms; or alteration of entries or entry forms.
- Participants also agree (a) to be bound by these Official Rules; and (b) that the decisions of Sponsor are final on all matters relating to the Drawing. Winner agrees to be bound by these rules and the decisions of Sponsor, whose decisions are final and binding.
- If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consent thereto. You further warrant that your actions do not violate your employer’s or company’s policies and procedures.
This Drawing is governed by the laws of the Commonwealth of Virginia, USA, without regard to the conflicts of law provisions.
All disputes, claims or demands that relate to these Official Rules will first be brought to the attention of the other party and will be resolved individually, without resort to any form of class action. The receiving party shall have sixty (60) days from the date of such notice to remedy the described breach or violation and notify the complaining party in writing of the resolution. If the dispute, claim or demand is not resolved to the satisfaction of the complainant within 60 days, the complainant may request an informal resolution conference (mediation), which if agreed to by the other party will be scheduled to occur within 21 days of the written response. Each party shall have the right to be represented at such a conference by counsel and will ensure that a decision-maker with full and complete authority to resolve the dispute attends the conference. Such conference will be in front of a third party mediator chosen by the parties. If the parties do not agree to conference or are unable to resolve a dispute after such a conference, the parties agree that exclusive jurisdiction for any dispute, claim or demand related in any way to these Official Rules will be decided by binding arbitration. All disputes between the parties, of whatsoever kind or nature arising out of these Official Rules, shall be submitted to JAMS (www.jamsadr.com<http://www.jamsadr.com) for binding arbitration under its rules then in effect in the Washington, DC area, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.
Entry into and acceptance of any prize related to this Drawing constitutes permission for, and winner’s consent to, GMAC and its agencies or assigns to use the entry and the names, country of residence and/or likenesses of any winner for advertising and promotional purposes, in any media now or hereafter known, without further notice, compensation, consideration, review, or consent, except as prohibited by law.
